Indefeasible

Prevalent – Widespread, Dominant, and Unbeatable · BOOK OF CAUSE

Definition

Indefeasible means legally incapable of being annulled, voided, or overturned. Inviolable, by contrast, means protected from violation due to moral, legal, or sacred authority, but not necessarily permanent in a legal sense. Indefeasible focuses on irreversible legal validity and permanence. Inviolable focuses on being untouchable because of rights or sacredness, which could theoretically be changed by law.

What it describes

A woman inherits a piece of land from her grandfather. The deed has been registered for fifty years, and no one has ever questioned her ownership. A neighbor suddenly claims that part of the land belongs to him. They go to court. The judge examines the documents and rules that her ownership is absolute and cannot be taken away, no matter what the neighbor says. What kind of ownership does the woman have? She has an indefeasible title to the land.

Examples in context

  • The constitution grants citizens an indefeasible right to free speech.
  • Once the property is registered, the owner holds an indefeasible title.
